We applaud Judge Nicholas Kearns who scored a victory for sanity over what he described as “compensation culture gone mad”, as he rejected the High Court appeal brought by Vanessa Behan, on behalf of her daughter Robyn Behan.

We first reported on this case in Judge Dread back in the summer. The adventurous toddler had managed to get her finger stuck in a sugar dispenser at Eddie Rockets, but emerged from the incident largely unscathed.

If the appeal had been successful it could have closed down a small indigenous Irish business and have serious implications for what are already onerous health and safety regulations in this country.

What’s most galling about this case is that having been dismissed in the Circuit Court, the claimant had the temerity to appeal in the High Court.

Could this be an early indication of a change in attitude amongst the judiciary? It’s too early to call at this stage but ultimately judges should be showing zero tolerance towards this kind of flagrant greed and opportunism.
